    Frequently Asked Questions for Surrogates

What’s the difference between gestational and traditional surrogacy?

In gestational surrogacy, the surrogate has no biological link to the child. In traditional surrogacy, her own egg is used, creating a genetic connection.

What are the requirements to be an eligible surrogate?

Most agencies require surrogates to be between the ages of 21 and 40, in good health, have carried at least one pregnancy to term, and live in a state where surrogacy is legal.

Why do I need a surrogacy attorney?

An attorney ensures your contract is strong, compensation is fair, and your health and privacy are protected. You’ll also have someone to answer questions and advocate for you throughout the process.

What if the intended parents live in another state?

Your contract will comply with the laws of your state of residence, even if the intended parents live elsewhere.

    Does FSLG handle traditional surrogacy?

Yes. While gestational surrogacy is most common, we also provide legal services for traditional surrogacy arrangements.
