Are Gestational And Traditional Surrogacy Legal In Florida?

Both gestational and traditional surrogacy are legal in Florida, but the state has specific laws and regulations that ensure the protection of all parties involved. Gestational surrogacy involves a surrogate who carries a baby not genetically related to her, while traditional surrogacy involves a surrogate who uses her egg. At Fertility & Surrogacy Legal Group, APC, we are a nationwide surrogacy law firm that thoroughly understands the applicable Florida laws. We are here to guide you so that you ensure your parental rights and follow the law.

What Are Florida’s Surrogacy Laws?

Florida has clear and comprehensive surrogacy laws. One key aspect is the requirement for a binding and enforceable gestational surrogacy contract. This contract must be made between the commissioning couple and the gestational surrogate. For the contract to be valid, all parties involved must be at least 18 years old and the commissioning couple must be legally married.

The commissioning couple can only enter into a contract with a gestational surrogate if a licensed physician determines that:

  1. The commissioning mother cannot physically gestate a pregnancy to term.
  2. The gestation will pose a risk to the physical health of the commissioning mother.
  3. The gestation will pose a risk to the health of the fetus.

A gestational surrogacy contract must include several provisions:

  • The surrogate must be the sole source of consent regarding clinical intervention and pregnancy management.
  • The surrogate must agree to undergo reasonable medical evaluations and adhere to medical instructions about her prenatal health.
  • The surrogate must agree to relinquish any parental rights upon the child’s birth and to proceed with the necessary judicial proceedings.
  • The commissioning couple must agree to accept custody and assume full parental rights and responsibilities for the child immediately upon birth, regardless of any medical impairment.
  • The surrogate must agree to assume parental rights if it is determined that neither member of the commissioning couple is the genetic parent of the child.

The contract can go beyond these minimum requirements. For example, you can also include agreements about reasonable living, legal, medical, psychological and psychiatric expenses related to the prenatal, intrapartum and postpartum periods.
