General Legal & The FSLG Process

Why should I call FSLG first, before an agency or clinic?

This is a critical first step. Many agencies and clinics may present legal documents early in the process and ask you to sign without independent counsel. Calling FSLG first ensures you get expert legal advice from the very beginning, helping you avoid common pitfalls and costly mistakes.

What is the difference between parental establishment and adoption?

Although there are some similarities, the pre-birth order process differs from the adoption process in that a home study or visit is not involved. Additionally, pre-birth orders are obtained in less time and have more certain outcomes.

Does FSLG work with clients outside of the U.S.?

Yes. FSLG has a nationwide and international reach, with translation services available for Chinese, Spanish, French, Portuguese, and German speakers. We work with clients from almost every country and have the multi-state expertise needed to ensure your journey is legally secure.

What if I live in a state where FSLG is not licensed?

FSLG has a vast nationwide network of reproduction law attorneys, ensuring that our agreements are always in full compliance with the laws of your state of residence, regardless of where you live.

Parental Rights & Family Structures

How do you ensure my parental rights are secure, especially if I’m an LGBTQ+ or non-biological parent?

FSLG specializes in legal protections for LGBTQ+ and non-biological parents. We use legal tools like Pre- and Post-Birth Orders and Second-Parent Adoptions to ensure full legal parentage. We also ensure your agreements are legally sound and enforceable from the outset, protecting you from disputes over custody or parental rights.

Can FSLG help me with a surrogate or egg donor?

Yes. We act as supportive advocates for both surrogates and egg donors, ensuring their agreements are customized and negotiated to protect their health, privacy, and compensation. We also provide legal clearance letters and work with agencies to ensure a smooth process.

How does FSLG work with Agencies and Clinics?

We serve as a valuable partner to minimize risk for new and established fertility companies. We develop compliance strategies, prepare strong contracts, and offer in-house accounting and escrow services to alleviate the burden of financial compliance.

Logistics & Post-Birth Documentation

How do we get the birth certificate?

After we obtain your court order, which confirms parentage, we send it to the Department of Vital Statistics to get a birth certificate. The birth certificate is mailed to our offices, and then to you.

How do I get a Social Security card for my child?

In order to obtain a Social Security number and card for your child, you’ll submit a request form. It will not be sent automatically. The application for a newborn Social Security number can be found on the website for the United States’ Social Security Administration.

How do I obtain a passport for my child?

In order to obtain a passport for an infant, you’ll fill out an application. It can be found online or downloaded from the United States Department of State. If you plan to travel out of the country, please inform our staff, as we can help you obtain an expedited passport in a matter of 5-7 days.

Can FSLG help me with managing funds and payments?

Yes. We offer in-house accounting and escrow management services with a dedicated team. This ensures that funds are handled professionally and judiciously, with itemized statements for full transparency.
